1. Acceptance of Terms
By accessing or using the ToorBus website, mobile applications, or any related services (collectively, the “Platform”), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Platform. We reserve the right to update these terms at any time, and your continued use of the Platform constitutes acceptance of any modifications.
2. Description of Service
ToorBus operates an online marketplace that connects individuals and organizations seeking charter bus transportation (“Customers”) with independent charter bus operators (“Operators”). ToorBus does not own, operate, or control any buses or transportation vehicles. We facilitate the connection between Customers and Operators and provide tools for quoting, booking, and payment processing.
3. User Accounts
Certain features of the Platform require you to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information during registration and to update your information as necessary. ToorBus reserves the right to suspend or terminate accounts that violate these terms.
4. Booking & Cancellation
All bookings made through the Platform are subject to the specific terms and conditions provided at the time of booking, including the cancellation policy of the individual Operator. Cancellation fees vary by Operator and are disclosed before you confirm your booking. ToorBus will make reasonable efforts to process cancellations and refunds in accordance with the applicable Operator's policy, but final decisions regarding refunds rest with the Operator.
5. Payment Terms
Payments for services booked through the Platform are processed by ToorBus on behalf of the Operator. By submitting payment information, you authorize ToorBus to charge the applicable amount to your designated payment method. All prices are quoted in U.S. dollars unless otherwise specified. Additional charges such as tolls, parking fees, and driver gratuity may apply and will be communicated at the time of booking or after the trip.
6. Limitation of Liability
ToorBus acts solely as a marketplace intermediary and is not liable for the actions, omissions, or negligence of any Operator, driver, or third party. To the fullest extent permitted by law, ToorBus shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Platform or any transportation services booked through the Platform. Our total liability to you for any claim shall not exceed the amount you paid for the specific booking giving rise to the claim.
7. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of laws principles. Any disputes arising from or related to these terms or your use of the Platform shall be resolved exclusively in the state or federal courts located in Wilmington, Delaware. By using the Platform, you consent to the personal jurisdiction of these courts.
